Marketplace Publishing Policy

1. Introduction

This Marketplace Publishing Policy is the bridge document between eBodhya Studio and eBodhya Marketplace. It explains what happens, legally and operationally, when you use the Marketplace Publishing feature to push Content from Studio live on marketplace.ebodhya.in. It applies to every Creator, Institution Account, and Publisher Account that chooses to publish Content this way.

3. Applicability

This Policy applies to any User who uses Marketplace Publishing to push Content from Studio to eBodhya Marketplace, and governs the relationship between your Studio-side authoring workflow and the resulting live Listing.

4. Legal Entity

eBodhya™ is a trademark owned and used by Anomaa Studio, a sole proprietorship business based in Bengaluru, Karnataka, India ("Anomaa Studio," "eBodhya," "we," "us," or "our"). Anomaa Studio owns and operates the entire eBodhya suite of platforms, comprising:

Every account, subscription, order, listing, or agreement created or entered into through any eBodhya Platform is an agreement with Anomaa Studio directly. No eBodhya Platform is owned, operated by, or offered on behalf of any third party, franchisee, reseller, school district, or unrelated entity, unless we state so expressly and in writing. eBodhya™ and the eBodhya logo are trademarks of Anomaa Studio; no license to use them is granted except as expressly permitted in writing.

In this document, "the Platform" means eBodhya Studio (studio.ebodhya.in) specifically, and "eBodhya" or the "eBodhya Platforms" means the wider suite of products described above.

5. Marketplace Publishing Binds You to Marketplace Terms

Using Marketplace Publishing to push Content live also binds you, as a seller, to eBodhya Marketplace's Seller Agreement and Licensing Policy. Those documents govern your obligations as a seller and the license a buyer or licensee receives once they acquire your Listing. This Policy governs only the Studio-side workflow that gets your Content to that point; it does not restate the Seller Agreement or Licensing Policy in full.

6. How Studio Choices Map to a Live Listing

When you initiate Marketplace Publishing, the pricing, licensing type (for example, single-use, institutional, or multi-seat), and Metadata you configure in Studio are transmitted to Marketplace and rendered as the live Listing's price, license terms, and catalog metadata. Changes you make in Studio to an already-published item (price, licensing type, or Content itself) do not automatically update the live Listing; you must republish or explicitly sync the change through Marketplace Publishing for it to take effect on eBodhya Marketplace.

7. Withdrawing a Published Listing

You may withdraw a published Listing at any time through the Marketplace Publishing panel in Studio or directly on eBodhya Marketplace. Withdrawal removes the Listing from future sale but does not affect buyers who purchased or licensed it before withdrawal; their rights continue under the Licensing Policy and eBodhya Marketplace's Digital Download Policy.

8. Keeping Studio Version History and the Live Listing Consistent

Studio's Version History continues to track edits to your Content after publishing, but those edits are drafts until you republish. To avoid a mismatch between what a buyer purchased and your current draft, republish through Marketplace Publishing whenever you make a substantive change you want reflected in the live Listing, and consider noting material changes in the Listing description so existing buyers understand what changed.

9. Privacy

Personal Data associated with your Listing (such as your Creator Profile name) is handled per our Privacy Policy and eBodhya Marketplace's privacy policy where applicable to the buyer-facing Listing.

10. AI

AI Output must pass the mandatory review described in our AI Content Generation Policy before it is published via Marketplace Publishing.

11. Data Processing

Personal Data Processed in connection with Marketplace Publishing is handled per the Privacy Policy and the DPDP Act, 2023.

12. Cookies

Not directly relevant to this Policy; see the Cookie Policy.

13. Third-Party Services

Marketplace Publishing interoperates with eBodhya Marketplace's own infrastructure, payment processing, and licensing systems, described in eBodhya Marketplace's own legal documents.

14. Security

Publishing credentials and the Studio-to-Marketplace transmission of Content and pricing data are protected using the measures in our Security Statement.

15. Retention

Records of publishing actions, including price and licensing configuration history, are retained per our Data Retention Policy.

16. Deletion

Deleting Content in Studio does not remove an already-published Listing; see Section 7 above and our Data Deletion Policy.

17. Intellectual Property

Publishing to Marketplace does not transfer ownership of your underlying Content; it grants only the license described in the Licensing Policy, consistent with our Intellectual Property Policy.

18. User Responsibilities

Before using Marketplace Publishing, you must ensure your Content has passed Editorial Review under our Content Publishing Policy, that your pricing and licensing configuration is accurate, and that you understand the Marketplace's own Seller Agreement and Licensing Policy.

19. Prohibited Activities

You must not publish Content that has not passed Editorial Review, misconfigure licensing to misrepresent what a buyer receives, or use Marketplace Publishing to circumvent an Exclusivity Agreement described in our Creator Agreement.

20. Limitation of Liability

To the maximum extent permitted by Applicable Law, Anomaa Studio's liability arising out of this Policy is limited as described in the Terms of Service. Nothing in this Policy limits liability for fraud, willful misconduct, or statutory rights that cannot be waived.

21. Disclaimer

We provide the Marketplace Publishing feature on an "as is" and "as available" basis and do not guarantee successful transmission or synchronization in every case; verify your live Listing after publishing.

22. Termination

Termination of your Studio Account does not automatically remove Listings already published, per Section 7 and our Creator Agreement.

23. Governing Law and Dispute Resolution

This Marketplace Publishing Policy and any dispute, claim, or controversy arising out of or relating to it, the Platform, or the Services (a "Dispute") is governed by the laws of India, without regard to its conflict-of-laws principles.

The parties will first attempt in good faith to resolve any Dispute through informal negotiation for thirty (30) days after one party gives the other written notice of the Dispute. If the Dispute is not resolved within that period, it will be referred to and finally resolved by arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by Anomaa Studio. The arbitration will be conducted in English, and the seat and venue of arbitration will be Bengaluru, Karnataka. The award of the arbitrator will be final and binding on the parties.

Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief before a competent court at any time. Subject to the arbitration agreement above, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any Dispute not subject to arbitration and over any proceeding to enforce an arbitral award.

24. Jurisdiction

Without prejudice to the arbitration agreement above, the Platform is directed at Users in India, and Anomaa Studio makes no representation that the Platform or its Content is appropriate or lawfully available in other locations. Users who access the Platform from outside India do so on their own initiative and are responsible for compliance with local law.

25. Changes to This Policy

We may update this Marketplace Publishing Policy from time to time to reflect changes in the Services, Applicable Law, or our practices, and will post the revised version on the Platform with an updated "Effective Date."

Grievance Officer

In accordance with Section 5 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the grievance redressal requirements of the DPDP Act, 2023, Anomaa Studio has designated a Grievance Officer for the eBodhya Platforms, reachable at grievance@ebodhya.in. The Grievance Officer will acknowledge a grievance within twenty-four (24) hours of receipt and will endeavor to redress it within fifteen (15) days, or such other period as Applicable Law prescribes.

If you are not satisfied with our response, you may escalate a Personal Data grievance to the Data Protection Board of India, or pursue any other remedy available to you under Applicable Law.
