Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of eBodhya Studio, Anomaa Studio's AI-powered educational content creation platform. They bind every Creator, Institution, and Publisher who registers an Account or otherwise uses the Services, and exist to set out the rights and obligations of both you and Anomaa Studio.

These Terms apply to all Users of the Platform, whether registered under a Creator Account, Institution Account, or Publisher Account, and to visitors browsing publicly available pages of studio.ebodhya.in. They govern all Services offered on the Platform, including AI generation features, Collaboration, Document/Image/Video Upload, Question Banks, and Marketplace Publishing.

4. Legal Entity

eBodhya™ is a trademark owned and used by Anomaa Studio, a sole proprietorship business based in Bengaluru, Karnataka, India ("Anomaa Studio," "eBodhya," "we," "us," or "our"). Anomaa Studio owns and operates the entire eBodhya suite of platforms, comprising:

Every account, subscription, order, listing, or agreement created or entered into through any eBodhya Platform is an agreement with Anomaa Studio directly. No eBodhya Platform is owned, operated by, or offered on behalf of any third party, franchisee, reseller, school district, or unrelated entity, unless we state so expressly and in writing. eBodhya™ and the eBodhya logo are trademarks of Anomaa Studio; no license to use them is granted except as expressly permitted in writing.

In this document, "the Platform" means eBodhya Studio (studio.ebodhya.in) specifically, and "eBodhya" or the "eBodhya Platforms" means the wider suite of products described above. Where this document imposes obligations on "Anomaa Studio," those obligations are undertaken by Anomaa Studio in its capacity as operator of the Platform.

5. Eligibility and Accounts

You must be at least eighteen (18) years old to create an Account, or you must be acting on behalf of, and with the actual authority of, an Institution Account or Publisher Account. By creating an Account you represent that you meet this requirement and that all information you provide is accurate and current.

Account types:

You are responsible for all activity under your Account and for maintaining the confidentiality of your login credentials.

6. Subscriptions, Billing, and Fees

Access to certain Services requires a paid Subscription Plan. Subscription fees, included AI generation credits, and feature limits are as displayed on the Platform at the time of purchase. Subscriptions automatically renew for successive periods equal to the initial term unless you cancel before the renewal date. We may change Subscription fees or plan features on prospective renewal terms with reasonable advance notice; continuing your Subscription after a fee change takes effect constitutes acceptance of the new fee. All fees are exclusive of applicable taxes unless stated otherwise. Refunds, where available, are handled per the billing terms displayed at purchase; contact sales@ebodhya.in for billing queries.

7. License to Use the Services

Subject to these Terms and your Subscription Plan, Anomaa Studio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal educational content creation and, where applicable, publishing purposes. This license does not permit resale or sublicensing of the Services themselves, reverse engineering, or use of the Services to build a competing product.

8. User Content: Ownership and License to Us

You retain all ownership of your User Content. By uploading, submitting, or generating User Content through the Platform, you grant Anomaa Studio a worldwide, royalty-free, non-exclusive license to host, store, process, reproduce, and display that User Content solely as necessary to operate the Services for you — including running AI features on it, enabling Collaboration with co-authors you invite, and maintaining Version History. If, and only if, you choose to use Marketplace Publishing, you additionally grant the rights described in our Marketplace Publishing Policy and eBodhya Marketplace's Licensing Policy to make that Content available for sale or license on eBodhya Marketplace. We do not otherwise sell, license, or repurpose your private User Content.

9. AI Features

AI Question Generation, AI Worksheet Generation, AI Presentation Generation, Lesson Plans, and other AI Assistants are provided subject to the AI Usage Policy and, for content-generation features specifically, the AI Content Generation Policy. AI Output may contain errors and requires your review before you rely on it or publish it. You are responsible for how you use AI Output, including verifying that it does not infringe third-party rights.

10. Marketplace Publishing

Marketplace Publishing lets you push finished Content from Studio to eBodhya Marketplace for sale or licensing. Using this feature binds you to the terms of our Marketplace Publishing Policy, which in turn cross-references eBodhya Marketplace's Seller Agreement and Licensing Policy. Content you keep private or share only within a Collaboration workspace is not affected.

11. Privacy

Our collection and use of Personal Data in connection with the Services is described in the Privacy Policy, which forms part of these Terms.

12. Data Processing

Personal Data handled in connection with these Terms is Processed in accordance with the Privacy Policy and the DPDP Act, 2023.

13. Cookies

The Platform uses cookies for essential, functional, and analytics purposes, described in the Cookie Policy.

14. Third-Party Services

The Services rely on categories of third-party providers, including cloud hosting, AI model providers, a payment gateway, and analytics providers, described further in the Privacy Policy. Anomaa Studio is not responsible for the acts or omissions of independent Third-Party Services you choose to connect to your Account.

15. Security

We maintain technical and organizational security measures described in our Security Statement. You are responsible for using a strong password and safeguarding your Account credentials.

16. Retention and Deletion

Account and Content data is retained and deleted as described in our Data Retention Policy and Data Deletion Policy.

17. Intellectual Property

Anomaa Studio owns all Intellectual Property Rights in the Platform, its software, AI models, and the eBodhya™ brand. You own your User Content, and AI Output ownership follows the AI Content Generation Policy. Full detail is in our Intellectual Property Policy and Copyright Policy.

18. User Responsibilities

You must: use the Services only for lawful educational content creation and publishing purposes; ensure you hold the necessary rights in any source material you upload; keep your Account credentials secure; comply with your Subscription Plan's usage limits; and, if you administer an Institution or Publisher Account, ensure sub-users comply with these Terms.

19. Prohibited Activities

You must not: upload Content you do not have the rights to use; use AI features to generate harmful, discriminatory, sexually explicit, or otherwise inappropriate educational material; attempt to extract, reverse-engineer, or scrape the underlying AI models; abuse Collaboration features to harass co-authors; circumvent Subscription or usage limits; or use automated tools to scrape or bulk-download Content. 20. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, except as required by Applicable Law. AI Output may be inaccurate, incomplete, or unsuitable for a particular purpose without human review, and Anomaa Studio does not warrant that AI Output is free from error or infringement.

21. Limitation of Liability

To the maximum extent permitted by Applicable Law, Anomaa Studio's aggregate liability arising out of or relating to the Services will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Anomaa Studio is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded or limited under Applicable Law, including statutory consumer protection rights.

22. Termination

We may suspend or terminate your Account for breach of these Terms, the Acceptable Use Policy, or Applicable Law, with notice where practicable. You may terminate your Account at any time via Account settings or by contacting support@ebodhya.in. Sections that by their nature should survive termination — including Sections 8 (as to Content already licensed to co-authors or Marketplace), 17, and 20–21 — will continue to apply. Effect of termination on already-published Marketplace listings is addressed in the Marketplace Publishing Policy.

23. Governing Law and Dispute Resolution

This Terms of Service and any dispute, claim, or controversy arising out of or relating to it, the Platform, or the Services (a "Dispute") is governed by the laws of India, without regard to its conflict-of-laws principles.

The parties will first attempt in good faith to resolve any Dispute through informal negotiation for thirty (30) days after one party gives the other written notice of the Dispute. If the Dispute is not resolved within that period, it will be referred to and finally resolved by arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by Anomaa Studio. The arbitration will be conducted in English, and the seat and venue of arbitration will be Bengaluru, Karnataka. The award of the arbitrator will be final and binding on the parties.

Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief before a competent court at any time. Subject to the arbitration agreement above, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any Dispute not subject to arbitration and over any proceeding to enforce an arbitral award.

24. Jurisdiction

Without prejudice to the arbitration agreement above, the Platform is directed at Users in India, and Anomaa Studio makes no representation that the Platform or its Content is appropriate or lawfully available in other locations. Users who access the Platform from outside India do so on their own initiative and are responsible for compliance with local law.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Services, Applicable Law, or our practices. We will post the revised version on the Platform with an updated "Effective Date" and, for material changes, will provide reasonable advance notice through the Platform, by email, or by an in-product notice, as appropriate to the change and the audience of the Platform. Continued use of the Platform after the revised Terms take effect constitutes acceptance of the changes. Where Applicable Law requires your express consent to a change, we will seek that consent before the change takes effect.

Grievance Officer

In accordance with Section 5 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the grievance redressal requirements of the DPDP Act, 2023, Anomaa Studio has designated a Grievance Officer for the eBodhya Platforms, reachable at grievance@ebodhya.in. The Grievance Officer will acknowledge a grievance within twenty-four (24) hours of receipt and will endeavor to redress it within fifteen (15) days, or such other period as Applicable Law prescribes.

If you are not satisfied with our response, you may escalate a Personal Data grievance to the Data Protection Board of India, or pursue any other remedy available to you under Applicable Law.
